What is the Enclave at Nash Springs HOA?
HOA stands for Homeowner’s Association. Enclave at Nash Springs Homeowners Association, Inc is the legally incorporated nonprofit established by the original developer before the initial sale of homes. The HOA is administered by an elected Board of Directors of Enclave at Nash Springs (ENS) for the mutual benefit of all residents within the community. The HOA aims to make ENS a highly desired place to live. We encourage each resident to be an active member of the community. Please read the Bylaws and Covenants of our community thoroughly. Many of us have heard the tales of HOA Boards being mad with power. We do not want to fine or place liens against community residents, but the Board will be vigilant in enforcing the Covenants. Am I a member of the HOA?
According to Georgia law, anyone who owns a home in Enclave at Nash Springs is automatically a member of the association. You CAN NOT choose to exclude yourself from membership. HOA membership is automatically extended to the spouse of a homeowner. All members must pay assessments and abide by the association’s restrictions.
How often does the HOA meet?
According to Georgia law, the Declaration, and Bylaws, the HOA are required to meet once a year. This meeting is called the Annual Meeting and is typically held in the Spring after annual assessments have been paid. In the interim, the Board of Directors may meet as necessary to carry out the affairs of the HOA. The president or all three directors may call a special HOA meeting.
Who are the Board of Directors?
The Board of Directors are residents living in or owning homes within Enclave at Nash Springs. They are responsible for the day-to-day governance. The board is governed by and acts according to the Declaration, Bylaws, and Rules of Enclave at Nash Springs and the non-profit corporate code under Georgia law.
How are board members selected?
According to the Declaration of Enclave at Nash Springs, an election is held at the Annual Meeting. The Annual Meeting is typically held in March after annual assessments (HOA dues) have been paid. Members must be current as of the election date with all assessments and fines to vote. Members not current are considered inactive and shall have voting privileges suspended until current.
How many directors serve on the board?

How long is the term of each board member?
According to the Declaration and Bylaws of Enclave at Nash Springs, each director serves a two-year term or until their successor has been elected or they resign. The terms are staggered to promote continuity.

What is a Modification Request Form?
According to the Declaration and Bylaws of Enclave at Nash Springs, a Modification Request Form, commonly called an ARC request, is used to CONTROL ALL EXTERIOR CONSTRUCTION and significant landscaping projects within Enclave at Nash Springs. Exterior refers to the outside of your home. Examples include Installing a privacy fence or irrigation and adding a porch or deck. You may also need a Gwinnett County Planning and Development permit and approval from Gwinnett County Code Enforcement during construction. The Board of Directors shall be the SOLE ARBITER of such plans and may withhold permission for any reason; PROJECTS MAYBE REJECTED ON PURELY AESTHETIC REASONS!! The Board of Directors shall be entitled to stop construction or initiate action to remove the building violating these restrictions. You MUST complete a Modification Request Form (MRF) and get approval BEFORE beginning. IF YOU COMMENCE WITHOUT APPROVAL, you will be subject to a fine or a daily fine of $25 for each day you violate and any legal expense incurred to enforce the removal of your VIOLATING CONSTRUCTION.
